Recent legislation significantly expands the New Jersey Family Leave Act. The NJFLA provides eligible employees working for covered employers with up to 12 weeks of job-protected leave to care for a seriously ill family member or to bond with a newly born, adopted, or foster child, among other reasons.
Effective July 2026, the employer coverage threshold drops from 30 to 15 employees, bringing a whole new group of smaller employers under the law for the first time. At the same time, revised employee eligibility standards apply across the board, meaning all covered employers will need to take note. Employees will qualify for leave after just three months of employment and 250 hours worked in the preceding 12 months, a significant reduction from current requirements. For employers already familiar with the law, the operational impact may be just as significant as it is for those newly covered.
